Marblehead Man Indicted on Fifth OUI

The indictments include two assault charges and stem from an incident last winter on Essex Street.

A Marblehead man awaits arraignment in Essex County Superior Court after a grand jury indicted him on charges including assault and battery.

39, of 14 Baldwin Road was indicted last month on two counts of assault and battery, resisting arrest, operating a motor vehicle with a suspended license and operating a motor vehicle while under the influence of intoxicating liquor, according to court records.

Driscoll has yet to be scheduled for arraignment on those indictments.

He was arrested Jan. 14 on his fifth operating under the influence charge after he crashed a van into a snowbank on Essex Street in Swampscott, the record states.

Police later found an open bottle of vodka with some of the liquor remaining and an open bottle of Kahlua in the van, the record states.

Driscoll resisted arrest and later, in the garage at the Swampscott Police Station, officers sprayed him with pepper spray after he kicked them with his work boots, police said.
