Man Charged with 5th OUI

The Marblehead resident is being held in jail pending a public endangerment hearing on Jan. 25.

A Marblehead man charged for the fifth time with operating under the influence was ordered held in jail pending a Jan. 25, hearing to determine if he represents a danger to the community.

Terence Driscoll, 39, of 14 Baldwin Road was arraigned in Lynn District Court Tuesday on nine charges.

Early Saturday morning,responded to a motor vehicle accident on Essex Street, according to court records.

The Dodge van Driscoll was driving had crashed into a snowbank along the guardrail, the vehicle facing south in the northbound lane with its headlights on.

The officer smelled alcohol on Driscoll’s breathe. Police later found an open bottle of vodka with some of the contents remaining and an open bottle of Kahlua with some of the contents remaining in the van, the record states.

Driscoll became agitated and combative after taking a field sobriety test, police said.

Driscoll resisted arrest and was taken to the ground where he continued to resist, police said.

Later, in the garage at the Swampscott Police Station, officers sprayed Driscoll with pepper spray after he kicked them with his work boots, police said.

Driscoll kicked one officer in the chest and another one in the thigh when they were trying to get him out of the cruiser, police said.

Police washed his face and eyes with bottled water and he was transported by ambulance to a Salem hospital, police said.

Driscoll was charged with operating under then influence, negligent operation, operating after license suspension, an open container violation, a marked lanes violation, two counts of assault with a deadly weapon -- kicking the officers with work boots — resisting arrest and disorderly conduct.

At his arraignment the judge ordered that he be held until it was determined whether he represents a danger to the community.

That hearing is scheduled for Jan. 25.
