After a brief struggle, the man told police he was able to get Furey to leave his apartment and on the way to the door Furey reportedly dropped four cigarettes that he was trying to steal from a pack left in the apartment, according to court documents.

When police went to question Furey minutes after the alleged incident, he reportedly pretended to be asleep in bed and claimed that he may have been sleepwalking.
