Robin M. Nicolo, 46, of 246 Humphrey St., Swampscott, pleaded innocent last week in Lynn District Court to a charge of breaking and entering a building during the daytime for a felony.

According to a report filed James Schultz, on Jan. 27 at 5:31 p.m., local officers responded to 246 Humphrey Street after a woman called police to report that her neighbor had stolen items from her apartment.

The woman told responding officers that she was laying down on her bed with headphones on when she noticed Nicolo rummaging around her apartment.

When confronted, Nicolo reportedly fled the apartment and allegedly stole cigarettes, a necklace and blood pressure medication belonging to the woman's husband on the way out, according to court documents.

When questioned by police, Nicolo reportedly admitted to entering the woman's apartment and told officers that "she thought it was OK to go into the residence because the door and lock were all busted up and the door was slightly ajar," according to the report.

Lynn District Court Judge Ellen Flatley released Nicolo on her own recognizance and ordered that she have no contact with the alleged victim. She is scheduled to return to court on March 19 for a pretrial hearing.
