You Ask Patch Answers: Is Smoking on the Beach Legal?

We posed this question to the director of the Swampscott Health Department

Over the weekend a Patch reader asked the following question: Is it legal to smoke cigarettes on the public beaches in Swampscott?
We put the question to Jeff Vaughan, Swampscott's director of public health.
Here is what the director had to say:
"Beaches are not regulated under the town smoking laws.
Leaving behind cigarette butts in the sand is littering."

So it looks like smokers are free to smoke on the beach but not to leave behind their cigarette butts.
